Maternity discrimination

Hi everyone,

Hoping someone has had a similar experience or any advice.

I work for a big corporation in a sales role. When I returned from maternity leave ( my son passed away at 7 hours old) I was pregnant and was taken off my old role and given an office based job.

This was justified by they want me to speak to occupational health. As I work in a sales role I get a base salary plus commission and bonuses. Doing the office work ment I had no opportunity to earn anything. Had my meeting with OH who said I could do my job but still have been kept in an office job. They dangled a carrot on a stick to me saying I could still earn bonus. Guess what I did all the work for my colleagues to earn there bonus but I didn't receive one as I didn't do any sales. I am fed up with being treated unfavourably due to being pregnant and am now looking to raise a grievance with HR. It is clear that I have only been treated this way due to being pregnant and my opportunities to earn money have been taken.

Has anyone had any experience with maternity discrimination as I am feeling stressed and alone right now and need go stand up for myself.

Any advice would be greatly appreciated 😃

You have the legal right to come back to an equal job; they cannot give you a lesser role. Have a look at ACAS’ advice around maternity.

@Jade4792 the OH report says you are able to return to your sales job.

Write to your manager and copy in HR. State you wish to raise a grievance for maternity discrimination and unlawful deduction of wages.

Tell them following maternity leave you are legally entitled to return to your contractual sales role. On (date) OH confirmed you are fit to return to your sales role and by not facilitating this they are acting unlawfully.

Advise them that in the 12 months prior to starting mat leave your average monthly bonus was £??. By not permitting you to return to the sales role you have suffered an unlawful deduction of wages of £ ?? per month. You expect to receive retrospective payment and resumption of your sales role.

As pp said talk to ACAS first.

Good luck

I work in healthcare and have been on maternity twice during the pandemic.. as my employer made the decision to remove me from patient facing into a non-clinical role they continued to pay my enhancements (I guess this would be the equivalent to your commision) based on my average earnings.
