Work/sick pay

I'm currently signed off work because of morning sickness. I gave my fit note to my employer and he says that I'm not entitled to pay as I haven't been there a year yet (my contract states that I'm not entitled to contract sick pay till after a year). But he said it's also SSP. So I'm not getting any pay. And have had to sign up for benefits.

Does this sound right about the SSP i thought every one was entitled. But I'm not as I haven't worked there for a year.

Sounds like he might be taking the piss. Check out the guidance here to see if you meet the criteria, but I don't think it has much to do with length of service. You just have to have done some work for your employer, which it sounds like you have.

No it sounds wrong about SSP
There is criteria you have to meet but it doesn't include 1 year of service

SSP doesn't kick in until day 4 so it will be unpaid for the first 3 days

How long have you been signed off for and how long have you been there? What do you mean by claiming benefits, what benefits?

Since august 2021.
on my fit note, there was a website to apply for esa if I’m not entitled to sick pay. So I filled that out.

And signed off for 10 days. I did have the option to use my holiday pay also.

Your employer should be paying SSP rather than you applying for ESA. Does he not have to give you an SSP1 form in order to claim anything else?

Yea that's what I thought. I haven't heard back from them yet so hoping they ask for forms and then I can tell him and hopefully he will have to pay me ssp.
