Husbands employer asking for my matb1 form

Is this normal?
He just wants his 2 weeks paternity leave, I thought the matb1 was just for my employer, I've never heard of it being needed for paternity leave.

It's not drama, it's the principle of it.
No wonder shitty employers get away with shitty behaviour if nobody ever questions anything.

They don't do sickness absence? Your husband's employer sounds very dodgy, even more so now they're insisting on something they have no right to ask for.

They are absolute twats.

The only time they have ever appeared to be decent is when he sliced his hand open on a machine at work and they drove him to A&E and picked him up. They treated him to a McDonald's and let him have the next day off fully paid. He thinks it was so nice of them, I'm more cynical.
They get away with it because DH is a foreign national and doesn't know how it should work in the uk. I tell him and he can see the difference between how my employer and his behave but he just shrugs it off.

It is the woman's personal medical information. It contains the details of her midwife. Some people might have no issues but there are numerous reasons why some people might.

User354354 · 25/05/2022 12:14

I'm struggling to see why you have an issue sending them a copy? Am I missing something ?

Because they have no right or need to ask for it

LaBellina · 25/05/2022 12:17

I wouldn’t be happy to share personal medical details with strangers that are not entitled to get that information and therefore the document. It’s illegal for a reason and I wouldn’t give it to them.

Oblomov22 · 25/05/2022 12:17

Submit the SC3 Form, via email. Then there'll be a paper trail. Then you can see what their written response is.

Because it's not for them! The matb1 is for my employer. They have no right to ask for it.

There's no personal medical details on it, other than a due date, which their partner's employer would know anyway if he's asking for paternity leave. Honestly, some people like to make things overcomplicated.

LaBellina · 25/05/2022 12:26

I didn’t share my due date with people when I was pregnant. I didn’t share who my midwife and doctor were, either. I definitely consider that personal information and I know there are other women who feel the same. It’s not up to you to decide that this isn’t personal and that people just need to get over it.

User354354 · 25/05/2022 12:27

Doesn't it just have due date and your name ? I'm really not understanding why you are trying to awkward by refusing it.

LaBellina · 25/05/2022 12:30

Why is it awkward to refuse to give someone a document with personal details that they’re not legally entitled to?
I find it rather always to defend the husband’s employer who’s not respecting the law 🤔

LaBellina · 25/05/2022 12:31

Akward not always

fairgame84 · 25/05/2022 12:33

I'm pretty sure that with DC1 it had my name, d.o.b and national insurance number on the back. So not just due date.

DH works for the local authority and they ask for a copy. Mine had no personal info other than my NHS number and DoB.

Hugasauras · 25/05/2022 12:38

As to why, I presume it's just for ease for dates and paperwork and stuff as all the info is there. I'm sure it's not mandatory.

Comefromaway · 25/05/2022 12:42

Some people might not wish their employer to know the name of their partner (maybe they have had an affair) or the name and registration number of the midwife.

Regardless of peoples personal opinion the government have decided that in order to claim paternity pay all an employee has to provide is the date the baby is due and a declaration that they are either the baby's biological father or in a relationship with the mother and that they are taking time off to support the mother/care for the child. The name or any other details of the mother is not required.

cloudydays2 · 25/05/2022 13:01

I had my midwife appointment yesterday and I received my form then, my midwife told me that my partners employer might ask for a copy for his paternity leave. I'm just assuming its a normal thing as proof of pregnancy so that paternity leave and pay is granted. All that was on mine was my midwifes name, my due date and my details.

This^^

My DP never needed it for both our DS's, I wouldn't share it personally OP

Jijithecat · 25/05/2022 13:27

It quite clearly states on the paternity leave section of the government website

'You do not need to give proof of the pregnancy or birth'

You don't need to give it to your partner's employer.

It has been a few years since I gave birth so the certificate may have changed but mine says at the top:

'This is your Maternity Certificate'

That would be mine and not my partner's. It's my personal information. My partner's employers didn't need it nor did they ask for it.

You don't need to provide it OP. If they treat him as badly as it sounds he might want to look for other employment once you're settled after your baby is born.

That very definitely is personal data and needs to be handled and stored appropriately.

Hugasauras · 25/05/2022 13:58

I imagine it is as it's local government and they do generally have processes in place.

Jijithecat · 25/05/2022 14:11

Hugasaurus, local government has nothing to do with it. They get things wrong all the time. That's one of the reasons why they have their own solicitors. Don't be fooled into thinking that they know right just because they're local government. Even the people that make and enforce the laws get it wrong e.g. MPs, the police etc.
Know your rights. You don't have to provide this information.

Comefromaway · 25/05/2022 14:18

One of the conditions of being allowed to handle and store special category data is having a legitimate reason for asking for the data in the first place.

Processing paternity leave & pay is not a valid reason.

What personal info? All it has on is your name, DOB, address, NI number and due date. I can't really see why people are getting their knickers in a twist about this.
