I am loosing my mind over time work situation. Hoping someone is more knowledgeable than me and can help! I work for an agency, who pretty much only recruits for the one company I work for. I’ve been there for 7 months and have worked there long enough to receive SMP. I’m not paid by the agency nor the company, I am paid by an outsourced company. They have been so difficult in terms of not paying me for my appointments off ect. Now I’ve received an email to say the company that pays me is now dissolved and is taken over by a new outsourced company .. where do I stand in terms of SMP? Is this paid by the new company as normal as I haven’t work for them for the minimum time?

And just to add to the confusion .. the company that pay me that’s on my wage slip isn’t the company I call for any pay issues 😕

As an agency worker you are entitled to SMP but bizarrely not to maternity leave. www.gov.uk/agency-workers-your-rights/maternity-rights-for-agency-workers I assume this is because you just say not available for work.

The change of payroll provider should not make a difference because you have continued to work for the same employer via the same agency.

However, I am not familiar with agency work so the situation you describe does raise potential red flags with me. Contact ACAS who are best placed to advise.
