Where would my son go?

Hello
I am in the middle of doing a will. My eldest son doesn't see his biological father. Cutting long story short it went to court who said supervised visits untill trust could be established. However his father didn't turn up and that was 7 years plus ago.
He relates to my husband as his dad.
If I was to pass away who would my son have to go to legally?
Do we need to seek adoption for my husband or will us being married be enough?
I am just worried that he would have to fight as my son could go to his biological father

His biological father would definitely have grounds to get custody of the child, personally, if the father has never shown interest and you can trust your husband to be a good parent to your child, I'd do a legal adoption etc. alternatively you could name your own family members. In my and my partners will we have stated that should anything happen to both of us that my son would go to my Mum and/or brother
