I handed in my MB1 certificate 4 weeks ago, now I know the Maternity pay is based off the last 2 months pay this is what I was told via Maternity action helpline and they worked out that I would be entitled to maternity pay from my employer, I went Into the office today to find out if it had all been sent off as I hadn't heard anything as yet and they told me I wouldn't be written to to inform me that I'm entitled to this, has anyone not been told ? Surely I have to have some sort of confirmation on this

They need to write back to confirm your start date and pay;

At least 15 weeks before the baby is expected, your employees must tell you the date that:

  • the baby is due
  • they want to start their maternity leave - they can change this with 28 days’ notice

You must then confirm their leave start and end dates in writing within 28 days

Employees can change their return to work date if they give 8 weeks’ notice.

You cannot refuse maternity leave or change the amount of leave your employees want to take.

I haven't handed anything else in yet apart from my MB1 I googled when do I need to tell them in writing what date I want it to start as I'm 25 weeks tomorrow so was going to write that out tonight and hand it In is that correct ? I've had nothing back since handing in my MB1

Hi I handed my matb1 form and also filled a form in from work stating when I want to leave and whether I will take the full 52wks off when I was around 28wks.
I got my confirmation letter and how much maternity pay I will receive last week at 34 wks.

I thought you had done your letter at the same time as handing in your MatB1. They wont write to you until they are confirming what you put in the letter you haven't done yet!

The latest you can inform them of the maternity leave start date is 25 weeks but you could have done it before that date. Once they receive your letter they have 28 days to write and confirm your maternity leave start date.

Great thank you no one at my work has really ask me for anything I'm 25 weeks tomorrow so I'll get it written up tonight and handed in I assumed they would write to me to confirm I was entitled to the pay and then ask when I would like to start maternity leave from thank you for your help

I just spoke to an old colleague of mine she said all that was needed was my MatB1 and that the office staff gave her a form to complete with her start date for maternity if she was coming back to the job once her maternity was done, I also have another issue as I work in a school as a one to one my job is coming to an end in July the child I work with leaves for secondary school so I won't know if I'm returning it if they have another job for me and if not I'll be made redundant, does anyone know what this form is called ??
