Hi
I've checked the gov website and it says we need to provide it within 21 days of smp start date or as soon as possible if the baby is born early. My work is insisting I need it before 25 weeks. I've had a quick Google and some none government websites say it's before 25 weeks.
I'm confused who is right. Does anyone know legally which is right?
I'm not seeing my midwife until just 25 weeks so if work are right I need to bother my midwife/gp for it asap since I'm 24 weeks now.

You need to give it before you reach 25 weeks.
Have a look at the Gov website as they make it clear it should be done this way. Also your partner should show it to his employer if intends to take paternity leave.

I had this too...
My appt was 25+3... and my midwife wouldnt give it to me any earlier.
Work were fine with it, as I handed it in on the day I got it.

I am pregnant with my second so I didn't see a midwife until 28 weeks. You need to give official notice to your employer 15 weeks before the expected week of confinement (i.e. by 25 weeks). Most employers have a form. The MAT1B is often included with that but it actually doesn't have to be. I gave in my form at around 23 weeks and then passed my form on when I got it.

Thanks for responding. I saw that @R2D2abc and I have let work know already, but further down that same page it says I have until 21 days after smp starts to hand it in. My work are anything but understanding so I may need to bother my midwife/ GP.

I would bother your midwife and try and arrange a time and day to collect a form, my boyfriends company were being really funny about it being handed in before 25 weeks and if I had waited for an actual midwife appointment it would have been too late to get the leave approval...my midwife didn’t mind me asking for it early Smile
