Just wondered what rights do we have going back to work after maternity? Does the employee have to offer a part time position? And if you don't go back to work after maternity do you have to pay your maternity pay back? I think my employer is going to be funny about me going back part time so want to be prepared for when the conversation comes!

Are you currently full time? No, thry don't have to give you part time, but you have a right to request it and thry need to consider it.

Re paying back mat leave, do ypu get over statutory? In which case I believe you do. Check your mat policy.

They don't have to offer you part time but you can ask about it and they have to at least consider it.

I didn't think you had to pay back SMP only if you got maternity pay from your employer.

I'm going for maternity discrimination as they've actually given my job to the person who was covering my maternity leave meaning I no longer have a position.. they don't know this yet as I still have a few months left but I'm not letting it go.

I’m not sure if I am 100% correct but fairly certain that they don’t have to offer you your exact job back. Just a job on a similar level & pay.
