Holidays before maternity

My works are trying to cancel my 2 weeks holiday before I go on maternity leave as said I can't take holiday first then go on leave. Which I know is rubbish as have 3 kids before. Taking leave From 21st April
. And holiday from 6th April . I think they have got the arse as it's Easter holidays and taking leave at 29 weeks. They even cancelled 2 weeks worth of holidays in March that needed using up trying to say gone over when pay slip says I have plenty left over. I feel like I am being bullied. I may quit after my maternity leave if I get another job while on leave

Yes, you're exactly right, they are wrong.

If I recall correctly, they are required to give you the opportunity to take all your holiday. If for some genuine reason that's impossible, they have to pay you all the holiday pay.

Have you got a HR department you can speak to? You're absolutely entitled to take holiday before maternity leave, it's exactly what I did in my last pregnancy and doing this pregnancy.

Actually, I'm wrong - they can't pay you on lieu, they have to allow you to take your holiday:

If they're telling you they've cancelled your leave because you're about to go on maternity leave, that is surely pregnancy discrimination?

when I was pregnant with my son I took the rest of my holiday before I went on maternity leave so I am pretty sure you are allowed to

My boss is trying to say cause April is a new tax year might be a chance I will not paid for holidays . And he wasn't sure if not I will earn enough for the following year. Think being manager you would know everything

This has course me so much stress I don't enjoy going into work. I was discriminated against when I come back after my last baby . Being bullied hoping I would quit which I haven't done as have 3 kids soon to be 4 kids. Even if it's got me depressed at times.

I would speak to citizens advice and your HR department. If it's because it's a new holiday year and you haven't earnt it yet then that's slightly different.

You accrue holiday while on maternity leave though, so unless they never let anyone take leave before it's accrued in a leave year, they can't give that reason for it.

Actually annual leave is discretionary to an extent so in theory they can dictate when you take your annual leave and cancel leave if the needs of the business dictate (although it would be extremely poor show to do so without good reason)

It starts becoming potentially maternity (sex) discrimination if your leave has been cancelled for the sole reason that you are tagging it onto the beginning of your maternity leave.

They have to give you the holidays you are entitled to though so if you don't get to take them before you start maternity leave you can add them onto the end of your maternity leave plus any you accrued during the time you were on maternity leave.

Basically he's an arse, but he doesn't actually have to let you take the leave before you go on maternity, but he's on pretty shaky ground if the only reason he's cancelled it is because of maternity leave.
