Hi ladies,

so i'm probably being a bit thick now, but what with baby brain and Christmas there isn't much hope haha!

i wrote my notification of maternity leave to my manager in September - i stated on it that i start my maternity leave on 21.12.18 - does that mean i don't have to work that day? meaning 20.12.18 would be my last day?
my manager never replied to my formal letter notification so have no idea.

also she takes xmas/boxing day out of our annual leave allowance at the start of each year.
she has deducted 9 hours from me for boxing day, but i will be on maternity leave then, so does that mean she owes me a day?

i have asked her direct via email and asked her this morning if we can discuss but she hasn't responded .

I always state "x will be my last working day" with any request...

But from what You've said - "starting from 21st" then I would take that to mean your last working day would be the 20th

Did you give her your MATB1 with your formal notification?

If Mat leave starts on 21st then your last working day would be 20th and yes, they owe you a days leave - you accrue leave as normal whilst on mat leave.

i did give my MATB1 in but cant remember the dates on it. I have my offical notification which states 'start my leave on 21.12.18' so that will be my first day of maternity leave.

my manager is arguing about the annual leave day for this boxing day stating i've already had it!!

we get all bank holidays deducted from our annual amount i the thought we will be there at that time of year, however my argument is i wont be there boxing day as mat leave has started so therefore wont be able to use that day as annual leave?

No you can't use annual leave in the middle of maternity. You can use it at the beginning or end which some people do so that they get some time off with full pay before the maternity leave/pay starts or as it ends.

It's surprising how little some managers understand about how maternity leave works!

You're right - Boxing Day cannot be put on any system as both annual leave AND maternity leave. Therefore you're entitled to use that day annual leave before you go (or ask for the 21st to be put as annual leave, maternity thereafter)

I’m assuming you will have to use the Boxing Day annual leave on your return as it won’t have occurred before your maternity leave start
