Paternity Leave - SC3 Form Question

Hi,

DH and I don't live together (relationship breakdown), but he would like to claim paternity leave to spend his days with the baby post birth and I would like him to bond with his child, too.

The SC3 form has 3 criterias that must be met, one of which is declaring that you live with the mother and the child 'in an enduring family relationship'.

Should I let him apply and give him a copy of my MATB1 form alongside this?

I think it means he is either the father or a partner living with the mother rather than both. .gov website says this:

Eligibility

You must be taking time off to look after the child and be one of the following:

  • the father
  • the husband or partner of the mother (or adopter) - this includes same-sex partners
  • the child’s adopter
  • the intended parent (if you’re having a baby through a surrogacy arrangement)

From form SC3:

You must be able to declare that:

• you're the child's biological father or the mother's spouse, civil partner or partner (including same sex partners) who lives with the mother and child in an enduring family relationship

It says or up there rather than 'and'
