Hi everyone.

Looking for some guidance. I'm 21 years old in a full time job. I'm 27 weeks pregnant and have just been told the company I work for are going into administration. Can anybody let me know what happens next with matenity pay and what I'm entitled to. Thank you

I'm unsure what happens but didn't want to read and run. You could maybe give ACAS or CAB a ring for advice. When a company i worked for went in to administration (wasn't pregnant at the time) we onky got wages we were owed nothing else. But when i was on maternity my last job closed down 4 weeks before i was due to return for work. I got the last of my maternity pay and all my holiday pay when they closed. X

You might qualify for maternity allowance from the government

If you were getting fired of being made redundant (but the company still going) your company would have to pay you smp at a minimum. My company paid company maternity as well when I was made redundant. I don't know if the company going into administration complicates things. Acas is probably your best bet. Maybe give them a call.

Fired or made redundant that should say. You are passed the magic 26wks, that is the main thing so you should get something.

Administration means they have no money though. So you may not get anything out of them. Your best bet may be the job centre or acas for advice x

* I don't know if the company going into administration complicates things. *

They have run out of money. Hence going on to administration. I’m afraid they are not required to pay you anything because, quite simply, “they” don’t exist anymore. The business is defunct.

Pop in to citizens advice and they will be able to confirm what, if anything, you are entitled to from the state

Good luck

smp is essentially paid by the gov though (the company claims it back). Gov.uk says the company should contact HMRC and the employee a disputes team
www.gov.uk/guidance/statutory-maternity-pay-business-changes-that-affect-payment

So you should get your smp op
