I think I know the answer to this but just thought I'd ask in case there's anyone from a hr or legal background around.
I've gotten wind that the company I work for are bringing in additional maternity pay over and above SMP, which is great, but I think this will happen whilst I'm on maternity leave.
Like I say, I think I know the answer and I'm thinking it's a big fat no, but (still clinging to some hope), do you know if I'd be entitled to it?

Usually the change will go live from a set date & only those giving birth after that date get the new benefit. I.e. Change live from 1/1/17, when my company did it only those where their MATB1 was after that date got the benefit

I'm not from a legal background but this is definitely a question you'd have to ask your HR team. With enhanced pay, companies can generally play around with the "rules" (how long you have to have worked there etc). Because enhanced pay differs from company to company, the only concrete information you can get would be from your employer :)

One thing to know is that you must return to work after otherwise you have to pay AML back

Am planning to go back so that's not an issue. More just wondering if we've got some unexpected cash coming our way or if we've just missed out (which will suck).
