paternity leave

My dp was made redundant 2 weeks ago but hopes to be in employment again within another couple of weeks.
Would he get paternity leave or not as our baby is due in May and he'll have only been at his job for a couple of months.

I haven't been given a matb1 yet but will ask for one at my next appointment if he might need it.

My dp started his new job on October, baby is due in 2 weeks - he is having to take 2 weeks holiday as paternity leave and pay is only available if he worked for the company basically when baby was conceived (15 weeks by the 26th week before being due or something)

He won't be entitled to statutory paternity leave or pay unfortunately. (Have to have been employed for 26 continuous weeks by the 15th week before birth).

He should try to negotiate better contractual paternity rights though if this is likely to be an option - I appreciate v much depends on the sector and the level though.

Taking annual leave should be an option though provided he gives adequate notice, no matter what.

I'm not sure how much annual leave he we be allowed to take so early on. He's currently with an agency whilst he retrains

Sorry to jump on this thread OP, but I hope it's okay to ask if anyone knows if my DH can get paternity leave as a supply teacher? I think this is considered the same as agency work. I'm googling but not getting anywhere. He changes schools as required as has been doing this for around 3 years. He will take aa month off between schools when DC1 arrives. I just wondered if he would be entitled to any pay? Thanks

Is he employed by an agency or by the LEA?

If he's employed then he might be entitled. If he isn't then he won't have the continuity of service,

Paternity pay is only just over £135 for two weeks though and so its not like he would be missing out on an enormous amount.

Thanks for the info redhat - I'll have to find that out from him. I can't believe men only get 2 weeks and women get 39!

Men can split the women's maternity leave though if that's an option.

DH changed jobs shortly after getting pregnant with DD. He wasn't entitled to leave but they did allow him to take 2 weeks unpaid.

My DH is in a similar position and so he asked his new employer if there is any alternative they could offer him. They suggested he take a week annual leave and they will match it with a week of compassionate leave. Maybe he could ask his employer the same?

brooke is he paid through an umbrella company or directly from the agency? He will be entitled to leave of some kind either way as he can just say that hes not taking bookings for a couple of weeks but in terms of pay if he is paid directly from an agency they usually dont get paternity pay.
