Thinking of resigning before mat leave

Hi, can anyone give me advice? I am currently living away from home and pregnant. I'm so excited but have no support at all. I want to move back home closer to family (currently in Wales) and want to move back to England and thinking about resigning after the 15th week of ewc. I couldn not afford to leave beforehand.

Can smp still be paid if I resign after the qualifying period and how is it paid I've I leave? Trying to find info online but so much to get my head around. Thanks

Could you start your mat leave at the earliest date possible and then resign once you are no longer being paid? I think you can start quite early.

I thought about that but paranoid I would get found out. I would need to wait 8 months to resign?

You still accrue holiday on mat leave so you'd be doing yourself out of ££ if you resigned beforehand. Go on mat leave and resign at the end instead, your holiday will then be paid as a lump sum.

SMP can also be paid as a lump sum at the beginning of mat leave if you ask for it.

I second cookiefiend and I think you can start mat leave at 29 weeks so wouldn't be too much longer than 25 weeks in the scheme of things. If £ is a big consideration you can tough it out for 4 extra weeks?

I think you'll get sma if you quit. So no 90% for 6 wks. Just go on may leave from 11 wks before due date. Then let them know you will not be returning you need to let know 4wks before you are due back. Do you have holiday left you could take on the run up to mat leave?

True, i think that might be the best option then. It's only a few weeks then means I definitely get it. Thanks for your advice. The thought of resigning when I like the company makes me feel like I'm being sneaky but wanting to leave for a geniune reason. I'm worried they might think I'm just desperate to leave to go on leave early but just have to tell them. Hate confrontation as already agreed in principal around 37 weeks but not written to them yet.

I left at 28ish weeks, took some holiday then mat leave. I moved away almost immediately so they knew I wasn't planning to come back. Towards the end of my mat leave I resigned effective the last day of mat leave and had all accrued holidays paid.

I was thinking of taking a week off before mat leave to leave a bit earlier. Can you do that?

You can finish at 29 weeks. You don't have to tell them you're not going back until 4 weeks before you're due back either

I just know it will be on the back of my mind and want to tell them than waiting. If I resigned say 26 weeks on leave, how would the remainder of smp work? Sorry don't have a clue how to tag people into these comments? Sorry

As PP have said you'd be better off resigning towards the end of maternity leave as you accrue holidays and bank holidays / any days the office is closed. Plans do sometimes change so probably better to wait until you've moved at least. All the best

It won't effect your mat pay if you resign once you are past 29 weeks. It might mean that you stop accruing annual leave. I got my AL entitlement paid out as a lump sum when I finally handed in my notice.

You can give the more notice, months in fact just state that the effective date is the day you are due to finish mat leave. The 4 weeks or a month is a minimum amount.

You could give ACAS a call if you're still not sure.

I resigned a few weeks before my maternity leave started as we were moving abroad. My employer continued to pay my SMP through PAYE until my 39 weeks were up, then sent me my P45. I did sacrifice my holiday allowance, but as I was moving continents it was pretty obvious I wouldn't be coming back so thought it best to be honest!

Just check on what your entitlement is, I get 18 weeks on full pay before going to SMP but if I resigned at the end without coming back, I'd have to pay a lot of that 18 weeks back.

I echo tril - go on mat leave don't say a word re-Crüe holidays and then send them resignation notice 4 weeks before due back that way you are a winner
