Starting a new job while pregnant- maternity leave

If I started a new job while pregnant, I wouldn't qualify for SMP but I would qualify for Maternity Allowance. Does that mean I still have a job at the end of maternity leave? Ie I know with SMP that you are given your leave and guaranteed your job if you return within 52 weeks. Does the same apply for an employee who doesn't qualify for SMP?

As far as I understand it, you are entitled to statutory maternity leave regardless of length of service (but not pay as you say). While you are on ordinary maternity leave (first 26 weeks) you have the right to return to the same job. If you also take additional maternity leave (up to a further 26 weeks) you are entitled to the same job or a similar one with at least the same t&c's.

So in brief your entitlement (or not) to SMP doesn't affect your right to return to work, unless you are made redundant.
