STAT PAY - Can someone help???

Hi,

Sorry this may seem a very silly question but I'm confused.

I have 25+ days holiday to take from work once Baby is due (19th July) work are more than happy for me to use my holiday whilst on maternity leave. I know that I get 90% pay for the first 6 weeks but say if after that I wanted to use my holiday entitlement do you get stat pay on top of this or do they stop paying you until your holiday pay has run out? I think stat pay is around £130 p/w so wondered if I would receive this plus holiday pay????

I think you either have to have holiday before or after the stat pay you can't have it as well iykwim

I had holidays to take when I went on maternity leave, and I just took them before my maternity leave/maternity pay started. So for example if I had 10 holidays to use, my maternity leave officially started on the 20th of Feb but I actually finished work on the 10th of Feb.

So whichever day you decide to finish work, you'll get 25 days' holiday pay and then your maternity pay will kick in. Or that's how mine worked, anyway.

My work paid me owed holiday money when I left in my last paycheck, then accrued holiday when I was meant to return after ML.

I would add that they were desperate for me to take actual holidays rather than give me money but they miscalculated and I didn't know I had a weeks leave left until my last week. It seems weird that you have not used up your holiday. They may plead with you to leave early.

Thanks, no my work are fantastic and are very happy for me to carry over my last years hol I have 3 days left then on 1st May I get a further 25 days hol and they are happy for me to use all of that too no pressure to take it before SMP kicks in. I'm not sure what to do to benefit me best financially.... Hmmm

As MissPentueth said, you should use your holiday up before you officially go on maternity leave (it must be before the baby arrives I think but that might be our company policy), then your Stat maternity pay will kick-in. If you're using holiday, you're technically on the payroll and not entitled to maternity pay.

Remember that you should continue to accrue holiday while on maternity leave (at your full time rate if you currently work full time). Then you can also use that up before you go back to work (assuming they agree to you using it that way). If, like me, you go back part time, that full time holiday (say for example it's 25 days) can be used up on a part time basis turning 5 weeks into 8 weeks if you work 3 days a week. I think I ended up going back to work 3 weeks later than I'd expected to and in total took about 14 months off.

I thought that you maternity leave legally starts the day your baby is born so you can take as much leave as you want to beforehand but not after the baby arrives/ your due date (whichever comes first).

You cannot be on SMP and paid holiday at the same time. Does your leave year run from the 1st May then? How much time off in total are you planning? I only ask as you only get 9 months pay during your 12 months mat leave. You could save your Annual leave until after your SMP runs out so effectively you will return to work but will be on annual leave. Does that make sense?

Cross posts! I took 13 months off as I had a full months annual leave to use up in a 1 month period - no brainer really.

Ok holiday's start 1st May to end of April following year. I have 3 days left over from this curent year (ends Monday 30th Apr) work happy for me to carry over. 1st May new holiday starts it's 25 days and I can take all at the beginning of the holiday start date so 1st May. Due 19th July planning/hoping to work right up to due date. Work ar willing to pay me 4 months up to 90% of my pay. So i'm trying to work out how to do this so that me and DH are financially better off. Am I making sense or just rambling? :)

This is just what I would do, but assuming your holiday year runs from 1st May till 30th April, then I would save your 25 days rather than taking them concurrently with your mat leave (if you are able to do that) and tag onto the end of your maternity leave to extend your maternity leave. eg if you were planning on taking 6 months off then you have 6 months, plus 25 days.
Depending on when/if you're planinng to go back to work you may want to save some to take after you back to work before the next holiday year starts

If you want to work right up to your due date then you have to start your mat leave on your due date. You can't just roll onto annual leave. But you can either take 25 days before the 19th July, or 25days at the end your mat leave

Thank you it's becoming much clearer, work had done me a spread sheet with exactly waht I would get paid each month but it was a little confusing..... Time to see accounts and speak to DH, blooming complicated stuff this pregnancy lark, my dogs were much simpler ;)
