Hi there can anyone advise me. I work part time and dont earn enough for SMP but am hoping to claim maternity allowance. My bosses are nt very forth coming with info but i think i am entitled to holiday pay whilst on maternity allowance even if they arent paying me SMP. If so how does this work? do i get it at the end of the 52 weeks? or should they pay me in advance if i request it? I need to discuss this with them i know but they are not very approachable so i wanted to get my facts straight before i tackled them over this...

You are not entitled to holiday pay during maternity leave, no. You are however entitled to accrue holiday throughout your maternity leave just as if you were at work. So if you are off on maternity leave for a year you will have a whole year's holiday entitlement to take. Most people take a chunk before they go on leave and a chunk on their return.

You're also entitled to your bank holidays.

i took my 4 weeks holiday before i started maternity as ours run from april to april, when i go back in July i'll be able to take some more.

that also applies to any other benefit you have with work (childcare vouchers/health benefits etc)

yes you accrue annual leave whilst on maternity leave. i had lots of problems with my employer becuase they were very uninformed about my rights and i had to really work hard to get them, i used the directgov website and also business link website to get all the facts, they're really useful.
