Do you get bank holidays back from mat leave?

Just found out that you accrue annual leave when on mat leave - yipee!
Does anyone know if you also get the bank holidays back?
Or does it depend on company policy?

Don't think so. In the same way that if you work part-time and don't have Mondays or Fridays as one of your contracted days then you just miss out a bank holiday. You don't get it in lieu or anything. Hence the reason that when I return to work 3 days a week, I'll be working Tuesday-Thursday!

I will be paid for my bank holidays with my annual leave that I have not used this year, in my Jan wages.

I will then get paid for the 2011 bank holidays that were due before I returned to work (Jan and Easter) in either my first wages after I return or the month before I am due back - can't remember what we agreed to. I assumed this was normal policy as my company usually give the bare minimum.

It depends on the company policy. I work for the NHS. My current trust does give you bank holidays, my previous one doesn't. Worth checking the maternity leave policy because, if I'd not pointed it out repeatedly quoting their own policy, they wouldn't have given me them.

my work policy is that I am entitled to any bank holidays after the 18th week of maternity leave.

Not in the NHS - not sure of other areas of work - check the mat policy.

I'm also in the NHS and won't be getting bank holiday leave. Plus I can't carry anything over until the next leave year anyway and have to take all this year's leave before my mat leave starts next month.

Just checked mine, and the reason that I get them is that my holiday allowance is only 20 days, the legal minimum is 28 days (as in 20 days hols + 8 days Bank holidays) so by law I have to be allowed to take them so they have to accrue when I am off or they wouldn't be giving me the even the minimum.

PickleSarnie - That's not correct about not getting BH's if you don't work those days.

If you work part time i.e. full days on Tues, Weds, Thurs you will get 3/5ths of the holiday a full timer would get for example a full timer at your work gets 25 days leave plus 8 BH a year = 33 days, so pro rata you would get 19.8 days (33 divided by 5 which is a full week times a 3 day week) - if you choose to work Mondays/Fridays and a BH falls on those days you would have to use part of your 19.8 days as annual leave if you want to get paid for those days (just as full timers have to use part of their overall 33 days to cover their BH's).

Back to the original question, my employer has added my BH entitlement onto my annual leave which I will be taking at the end of my maternity leave (baby due in 5 days...)

it's quite a complicated law that came in fairly recently. If you work for the part of the civil service that I do then yes you do get the BH's added onto your mat leave as you can't be on mat leave and BH at the same time. Try googleing the question and see what comes up
