My friend recently purchased a dog from gumtree as the seller no longer wanted the dog as they didn't have time for him anymore.
Since collecting the dog, my friend has recieved harassing messages asking for the dog to be returned as they have now decided they want him back. My friend has declined as he does not believe the owners were suitable and is concerned about the dogs welfare under their care (they were feeding inadequately and keeping him in the cupboard under the stairs). Of course if the sellers seemed genuine and good dog owners my friend would have considered returning him as he would hate to separate a pet from their owner. But it would not surprise me if the poor dog was returned that the owners would soon try sell him on again.
My friend has all the dogs paperwork, and has attempted to change over the microchip details to him. But this request was refused by the seller and the microchip company cannot change the details with out the approval of the seller who is registered to the microchip. The microchip company has advised to seek legal advice as this is a civil matter.
My friend has evidence of buying the dog including all messages leading up to selling and a paypal receipt of purchase.
By law owners must keep microchip up to date with the correct ownership contact details. My friend feels at unease that he cannot have the dog registered in his name and in case of emergency the ex-owner would be contacted.
Is there a legal way to get the microchipped changed, or consumer legislation that can be enforced to the seller so that they have approve for the sign over the microchip?
Would there be any repercussions for my friend if he kept the dog with a microchip that has incorrect owner details?
The poor dog is a lovely lad, and in desperate need of a loving home full of attention. The seller is now using the microchip as way of controlling situation in attempt to get the dog back. Any advice or guidance on this situation would be greatly appreciated. Or if you have experienced something similar we would appreciate hearing how things played out for you.
