Bath paints - at what age can baby/toddler use them?

I've just bought some. My DS is 16 months. It states not for under 3 on the packet, sue to choking hazard. Do you think he can use them otherwise?
Am paranoid about him swalloing stuff, but I guess these things are non-toxic?

It will be for choking - they can't be toxic that would be ridiculous!

You do know he will paint all over the walls until the end of time though don't you!

Despite what it says on the packet they do not wash off easily. The grout on the wall tiles in my bathroom is now a patchy yellow pattern thanks to bath paints. (dd1's drawing was lovely though)

Also watch out if your DS is prone to excema at all. Mine is and I have had to ban all bath paints and crayons as they make it worse.
