Can someone help with my CMS query?

I can't find any information about this online. My baby's biological father is not on the birth certificate, but the man who is in her life is (he is aware she is not biologically his). I'll take it I can't claim child maintenance from the biological father who has absolutely no interest in her?

Well yes you can put a claim in against the biological father….he may then take you to court to get his name on the birth certificate and obtain equal parental rights to you. He may also decide he wants 50/50 custody to avoid paying you any maintenance at all.

This.

To get money you would need to prove paternity too (if he disputes it).

I'm confident he will not want 50/50 or anything of the sort. He does not want anyone to know she is his.
It was more the different dad named on the birth certificate that I was unsure about.

You are trying to get maintenance from the man you fraudulently said was the father?

steamingin · 03/10/2025 22:20

You lied on the birth certificate? I'd be more worried about that than trying to claim maintenance. It's perjury and could carry a prison sentence.

Edited

No, from the father

Why have you put someone’s name on the birth certificate if they are not the biological father?

At what age will you be telling your child the truth about their parentage?

redemptionwoes · 04/10/2025 07:23

Oh I didn’t see you put someone else’s name on the certificate. Do you not see how unethical and immoral that is….its a legal document …one your child will have for life. It was your choice to continue a pregnancy with an unsuitable father so you should stand by the choices you have made and own them and you should have left it blank at best.

the fact you have put someone else’s name on it….well your made your bed there and will have to live with it. Highly unlikely you’ll get any maintenance out of the father you’d have to admit you lied on an official document for a start. All he’d have to say to CMS is it’s not mine Polomints even said it wasn’t because look I’m not on the BC 🤔

Why have you lied on am official document?
