To ask for ex’s payslip

My ex pays child maintenance however it is based on his previous job.

He now has another job and he’s refusing to tell me how much he earns. He is asking for the link To child maintenance calculation so he can do it himself however I don’t think he will be truthful to me About his earnings hence why I have asked for the payslip.

The child maintenance I’m getting at the moment isn’t very much, and I kicked him out Because of his extremely abusive behaviour.

I just want to know the amount he earns before tax on a weekly basis as he is paid weekly So we can use the correct child maintenance amount moving forward. It might even be less that he has to pay I just want to make sure that my daughter is receiving what she is entitled to.

He has also threatened to put her child maintenance money into a savings account for her instead that she can’t access u til she’s 18, as according to him if he put money into her savings account I will be entitled to less child maintenance money. I have never heard this before is this correct? Am I being unreasonable asking him for a payslip? He’s trying any thing to give me less child maintenance money and I don’t understand why.

Before I had a child I was living in a one bedroom and I was with him for 13 years before he cheated we moved to a two bed in order to accommodate our daughter and He should be paying child maintenance at the correct amount

Just go through CMS. He is NBU not to give you a payslip but is BU if he thinks he can just put the money into a savings account and not pay any.

Just go via CMS.

he is not being unreasonable to give you a payslip though

BananaCocktails · 19/10/2022 11:09

I wasn’t sure if they would help if he is already giving me maintenance
The last time we went through the CMS they Took it out of his wages as he refused to pay so I was trying to avoid a situation but okay I guess I may be being unreasonable in that aspect by asking
I just wanted confirmation of his earnings Without having to involve them, that’s all but yes I will speak to them and see what they say thank you for your replies

Go through CMS

HappyAsASandboy · 19/10/2022 11:36

Go through CMS. It doesn't mean they have to collect it through his payroll, or just means they'll inform you both of how much he has to pay. If he then doesn't pay it (and can't evidence paying it to you, not into some other savings account, then you can move to the collecting directly from his pay, at a cost.

CMS. I will say it again. CMS

girlmom21 · 19/10/2022 11:40

If he's only paying the minimum anyway I'd go through CMS too

@mummyh2016 he is paying the minimum based on his old earnings

You've got nothing to lose going through CMS then. Only reason I asked was because if he was overpaying you would then run the risk that CMS would reduce what you were getting.

I’m wondering if anyone recommending going through the CMS has actually used them recently? Is he employed or self employed? My ex is self employed but sub contracted so gets a payslip too, and he has managed to avoid paying by changing jobs regularly. If he is employed it is an easier process, if he is self employed it might be worth hearing what he offers and seeing if you’re happy with it. It’s not nice to feel like you’re being held to ransom by these men but I needed it here and now, not when the CMS might finally be able to do it. Hope it gets sorted soon
