Breaking contract with estate agent for private sale

We had a sole agency sellers agreement with our agent, and we're not happy with the service.

We've found a proceed-able buyer privately and would like to end our contract with the agent and go ahead with a private sale.

Can anyone please advise how to go about this?

Do we need to give the 28 days notice to the agent and after that, are we free to sell privately? Thanks

I'm no expert but as I understand you have to wait a minimum period after the contract ends which I think is usually 6 weeks.

How did you go about finding that buyer? I would be careful as I expect the EA can charge you a fee based on the promoting they did - read your T&Cs!

@Ilostit their friend was asking on their behalf our local Facebook group. They haven't gone through the agent or had any contact with them - though I did share the agent's listing with them. Would it be correct to introduce them to the agent now?

I think sharing the agents link with them would be classed as you using the agents services (ie their photos / description) so I think it would be difficult to avoid paying them

It really does depend on your contract with the agent though. No one can advise you reliably without reading that.

Even without you providing the link if the agent had it listed on a property website it would presumably be hard to be able to demonstrate the potential private buyer didn't see the house as a result of them marketing it.

You need to read the contract you signed. No one here can say what the agreement states.
