Need advice on s47

Hello,

Sorry I’m not a mum but I really need advice.

I am a law student so I am quite familiar with certain aspects of the law.

Due to some malicious comments made to the social, my family have been investigated under s47. The investigation ended today and they are reviewing the next steps. We have had early help working with us a year or so ago because of my wife being hospitalised and put in intensive care from covid and my current mental health, I don’t need to go into much details about that.

Anyway, I wanted to know if anyone here has any experience with s47? I asked the social worker for a copy of her review and she refused. Surely I’m legally allowed to get a copy of information regarding my family and it’s assessment? The Children Act 1989, in which s47 arises does not say they cannot provide me with a copy, but it also doesn’t say they can. Can I get a copy of the report?

If the investigation ended today then there likely won't be a report to read as yet!

You will be able to request a copy of your notes.
If you haven't been given information about that then request you are given it, or look online for it.

Some information regarding third parties may need to be redacted before the information is given to you so there can be a delay.

( also the paperwork will need to be completed first)

Yes you can get a copy of the assessment when it's written but they have between 15 and 45 days to write it up so it's probably not finished yet.
You won't get a copy of her notes or meeting minutes that you were not part of unless you make an application under subject access request and if so some will be redacted as for example you aren't allowed to see the police info without police disclosure.
