Child surname change

Hope someone can help, my eldest children (11 and 8) have no contact with their father. It's been 8 years. I do not have any contact information for him or his family. They are not interested in the children being on the planet. There are other factors involved including DV which I don't want to go into.

I have recently got married, been with my husband for nearly 7 years. He is the only father figure they have known. We also have a child together. The elder two have expressed their interest to change their surnames to my husband's. This was there choice. Has anyone done this without the other parents permission?

Again, contact is not possible.

Might have to do it through the court if you can't get permission from him

Would that be through family court? Should I contact them?
