Shared parental leave

My husband works for a company that offers 26 weeks full pay on the shared paternity leave scheme. It has to be taken within the child's first year of life.

At my company I only get the normal SMP.

So what we're trying to work out is if I was to take 9 months off, and then go back to work and he took the final 3 months off, would he then receive full pay during these 3 months because it's less than the 26 week they offer to him?

Or does he have to be off earlier than that? It says something on the government website about being able to share up to 37 weeks of pay between us - is that regardless of if it's SMP or the enhanced / company addition?

His HR department are useless and cannot give him an answer.

If his company offer 6 months full pay then he could take that from 9 to 12 months and still get full pay.

Check his policy - it could be 100% pay for the 39 weeks that SMP is paid for in which case you will have used all of that.
