We just got a nanny -confused as to whether I’m an employer or am paying for a service

Hi, wondering if anyone has experience of having a nanny. Found her online and she charges £12 ph. We pay her by doing a bank transfer each week. But we haven’t done a contract or anything like that. We checked over her references and have seen her crb and cv etc and now she’s here and helping (my husband works from home so she’s not been alone with our LO yet. I don’t feel completely comfortable eg if she took her out for the morning, yet).

She only is doing one morning a week and has just done two so far.

I am paying her for a service so didn’t think I needed to do a contract or anything or ‘employ’ her (don’t even know where to start with that if we did). Today I asked her for like a sheet of her ‘personal details’ like address and emergency contact details so we have a record of her being with us.

I feel like there is more I haven’t considered. Thought I’d take my cues from her but she hasn’t said anything about contracts etc. Wondering if she’s happy to do it like this and it’s more sort of relaxed. (Like in the old days when we used to trust each other). But I keep having intrusive thoughts like of that Liam Nissan film taken (or what was it called). I don’t actually want to employ her though as it sounds stressful and you have to pay holiday pay etc. Plus she is only doing 4 hours per week.

What are other people’s experiences?

It depends on what your agreement is.
Do you tell her where and when to work?
Or is she free to choose her hours and turn down work?

If you need her every Thursday 9am-1pm and she has to commit to that then you are probably her employer.

When you say you checked her references, did you actually speak to them?
