Ok so today I receive a phonecall from the CMS to say my son's father is denying parentage! This is the man who has constantly bombarded me with requests to have overnight access to our son which at present I am reluctant to allow due to issues with his health and lifestyle. I have offered access in ways whereby he has access to him alone ie picking him up and taking him out etc which was abused as he wouldn't bring him back at the agreed time. He had no contact with me or our son for the first 2 months of his life and contributed zero in maintenence or even clothes and essentials so i do have an issue with his commitment to our son. I also registered my sons birth alone therefore his name isnt present on the birth certificate. He doesnt live in the same town and I appreciate he has to travel to see our son and I have tried to be flexible with times because of this. He has no experience in parenting and by his own self admission admits that he doesnt wake even if a fire alarm was going off next to his head therefore it raises concerns as to how a baby would wake him. I have invited him to stay at our home to get used to waking in the night with a baby but he refused. I offered to bring our son to his hometown and stay, not to interfere or judge but just incase he didnt wake to our son but again that was refused. I have concerns with my son travelling a long distance with him also because he has a tendency to nod off at the wheel and did so a couple of years ago and nearly killed himself, he ended up in a ditch overturned and hospitalised! He basically suffers from sleep apnea but refuses to go through the sleep study to get the right treatment or help. So there are my reasons for not wanting him to have overnight access. He paid maintenence for about 2 months amd then stopped because ive denied the overnight access so I contacted the CMS and then received the news today that the case is now problematic because he has denied parentage and a DNA test will be needed to which of course I agreed. Im expecting him to take me to court to try and get overnight access. What rights to I have to defend my case if any?
