She is stopping him seeing his son.....

My uncles ex dp is stopping him seeing their son (my little cousin) unless she is working at the weekends and is stuck for a baby sitter. Their son is 3 years old and up until now he has stayed with my uncle 4-5 nights a week, so she can socialise/work etc. She is demanding that my uncle pays the full maintenance (which was calculated assuming he does not look after him that often). He has asked if it would be possible for him to pay less in light of this and she said 'right you arent seeing him during the week and only at the weekends if I cant get a babysitter!'

He is devastated and judging by the relationship my cousin and uncle had he will be distraught too. I have told my uncle to go see a solicitor (actually I called my solicitor and told him to go there now!) I was wondering what else I should tell/advise him to do.

I am that she has done this nasty spiteful horrible thing, it is my cousin who will lose out the most and she doesnt seem to care.

well if he can somehow prove that he has him 4-5 nights a week, the csa would lower payments automatically? duno though ..

How long have they been separated? How long did the 4=5 nights arrangement last? If he can prove that this arrangement worked for a reasonable length of time, then he should apply for a specific contact order (does he have parental responsibility - if not, he needs to apply for that first). She would need to show why she changed the arrangement.

Also, if he does get contact for that period, maintenance would be reduced. In fact, why does he not apply for residency? It seems to me that he had the child more than she did anyway.
