Holy Cow .. the glass on our neff cooker hood just exploded..

totally shattered glass all over new kitchen

was put in on Thursday (and has been tested) .. and it wasn't even on .. luckily noone was close but it shot glass right over the room (3.5 metres away) and into highchair

so lucky .. that was so scary

Hi Twiglett, sorry to ehar what happened - jsut wanted to give you soem advice.

Don't stop the cheque. Since you've already made the payment it is best to leave it at that.

Establish whetherthe manufacurer or te installer are at fault and get legal advice.

Is there is a fault, either with the installation or the actual product you will be entitled to compensation for your losses. This payment would be to cover all your losses and put you back in the position you were in before the incident occured.

So this would include repair or replacement of the damaged wood, the glass, etc. If there is a fault with the manufacture and the kitchen is designed aroudn it you should still be entitled enough compensation to sort your kitchen out properly.

You cnnot be compensated for hurt or suffering, but you should demand that all your monetary losses are compensated. don't settle for less!

May I ask why you think I shouldn't stop the cheque to the installers .. it is only for about 1/4 of the total payment (the rest given in cash) and if I don't stop it then I have no financial hold over them to make sure that if they are at fault they deal with things swiftly? They are a small one-man band plus assistants kind of outfit (though corgi registered / qualified and experienced)

because if you want to sue them for compensation, ie if they dont pay up - you will need to prove you have a contract with them. If you withhold payment, you are not fulfilling your side of the contract and it will make things messier. You don't need any kind of hold over them (IMO) if they don't pay up, get a solicitor. I don't know all the facts but it sounds like you have a very strong case.

btw I've nearly finished the second year of a law degree and your situation is so like the senarios I had to write about last year - that is where I'm comign from.

it seems weird to me as a lay person .. that if the worst possible scenario comes to pass I should be expected to be able to afford to put right what has gone wrong and wait for a settlement following a legal case .. but ho hum

twiglett, most cases like yours never get to court. They are usually settled by solicitors. All you would (likely) need to do is get a solicitor to write to them and eventually it would be sorted. Your legal costs would also be covered.

I understand that .. but if its anything like the compensation case we went through when DH was knocked off his bike by a car coming out of a side road and failing to stop with witnesses and police reports we could be out of pocket for over a year which when you look at what needs replacing and damage is a substantial sum

hopefully Neff will just deal with it .. still waiting

Hi KR

I bought a replacement and Mastercard are currently dealing with the initial one with the chip .. I have been told that the money will be refunded to my credit card and that I have to keep hold of the first sink for them to pick up .. unfortunately I bought the hood and hob from the same company ... arrrggghhhh

They don't know what happened

they are coming back on Thursday with the glass and will fit it and see if it could have been an installation error (even if it was I don't think the stuff should have exploded).. I am not sure how exactly I feel about having another one in the house tbh

I called the assistant to the bloke who fitted the kitchen and told him to give him the opportunity to be here .. but he said he couldn't make it

will see what happens on wednesday

Checked with DH by the way about screw covers - he said no problem getting them if you can't track any down.

Hmmm, a large virtual vodka with a choc bar on the side will be fine .

DH did mention going into the office to water his plants this week so might be able to sort then for you if he has a pack in his desk (which is more like a junk cabinet!) Otherwise, if he has to get them from stores, it will be in a couple of weeks when they reopen after the hols.
