Does anyone know what side of the garden do we legally have to replace? Is it the left or right?

in my case is the left we live in a semi, both fences are next to someones garden, but my next door neighbours house is in a corner so they replace both,i dont know if this helps

I think if the 'posts are on you side' then the fence is yours!

oops... I meant 'your'

Ours is the left hand side too. The fence posts thing applies to whoever erected the fence - so if the neighbour on your left decided to replace the fence for some reason then the fence posts would be on their side, although responsibility would still be yours I think. It should be in the deeds if you can find them!

Do this apply to council properties???

I think it normally is the left too. If you are in council property you can acually ring the council & ask them. My friend lives in council proprty & the council actually replaced the fence for them! (however they did have to wait ages & had no say in what type fence was errected)

ONE NOTE OF CAUTION......legally speaking when you replace your fence you are supposed to give the 'nice' side facing to your neighbour so that any maintence there after can be carried out on your side. My parents got caught out on this ruling very recent by they're silly neighbours complaining to council & they were made to dismantle it & put it the other way round...(some neighbours eh!!!)
