advice needed please...........(im the mum who wrote the thread about DP not being paid by work and we been left with no money)

sorry im not sure how to link in another thread for you to catch up on whats happend.

My DPs Company paid him only £15.08p for a month, there was BIG discussions and you all helped and we managed to get the company to agree to pay him what he s entitled to this week.
the company still hasnt paid him and he s been asking why and how long has he got to wait etc. they have agreed that they were the ones who made a mistake and would pay up this week. DP went to CA and they have told him that if the company has agreed the hours he is owed for and have agreed that they will make a payment, then said company by law should make a payment at the first available pay date (which was last friday, and the agreed last wednesday 24th feb that they were wrong) we're now 5th March and there still no pay.
DP phoned them this morning to enquire why and the person he spoke to from HR who is chasing it up said "well im not in tomorrow so i dont know who'll chase it then" so they still arent expecting to hear anything from payroll (which is in slough and we are in Swansea)
so really the long and the short of it is they are witholding payment leaving him with nothing he hasnt been able to get to work now because there is little fuel in the car he has explained that to them and they asked "is there any possible way" so he explained to them well no because you have only paid me £15.00 and that along with my child benifit has gone in my gas and electric meter to keep my family warm etc.
we have had to borrow money off my family and DPs family in order to have food and pay rent.
CA have now advised to write a grievience letter but it will take ages to get to the write person as its such a big company. then they said to take it to employment tribunal etc this could take ages.
what id like advice on is do you know if there is anyother actions we can take and would we be entitled to compansation for having to go in to debt etc. i dont think i can take anymore of it. they cant be left to get away with this.

Can you talk to payroll direct rather than going through HR? I used to work for a big company where HR and Payroll were in a different city. I'm pretty sure that when they mucked up my pay once they were able to get a cheque to me, rather than having to wait till next payday. They also refunded me all the bank charges I incurred as I hadn't realised I hadn't been paid and had gone overdrawn...

Is there a union rep who could help?

he s asked and asked and asked for the payroll details in slough to contact them direct and the answer he got was "we are the only one s who can contact them as they cant recieve incoming calls from outside lines" to which my DP replied "how am i able to contact you on this line then??" the reply was "um....um...um...i cant give you the details" he asked for a check but it all has to be authorised which no body seems to be doing!

I had a similar problem last year when my company clawed back my entire maternity pay. HR were hopeless and uninterested so I ended up googling to find head office phone number, got through to company switchboard and through to payroll that way. Fotrunately I spoke to a manager and it was sorted out within 24 hours. Could you look up details on t'internet and leapfrog HR?

i ll have a go we have been trying but they're absolute sods and you cant go outside of the company as it ll end up with immeadiate dismissle. one bloke there got sacked for summat and they even took his shoes off him!! he wanted to bring them in later that day but they wouldnt have it!! so he had to drive home shoeless!!

Look, they can't forbid you to join a union. If you are in Swansea, then give GMB a ring. They are opposite the station, and are great. There was a chap there called Jeff Bu*rns, not sure if he is still there but he is fantastic! I'm sure he'd be very interested in the background you've given.

The CAB advice is correct. You do need to write a grievance letter. Best way to do this is to address it to your DH's senior and line manager, and copy it to HR. Explain what you have done already, what is outstanding and when you expect payment. If you have incurred any bank charges, provide evidence of this and ask for these to be paid as well.

You don't need to wait until next payday. Payroll can easily make a BACS payment at any time, but it costs them money so they will try to avoid it. HR are being a bit silly here and are probably relying on you going away and accepting things.

yeah they did have a strop about bank charges!!! thanx for that info though i ll get DP on to it straight away!!
