hi,
hope someone can reassure me. a motorcyclist crashed into me while i was making a right turn last week. i had signalled etc and therefore believed that he was at fault. opened my post today to find a letter from one of those dreadful ambulance chasing legal companies to claim for damages because they believe it was my fault for making a right turn into a no right turn - which of course i didnt realise it was.
so am now panicing, am i even insured for making a no right turn, have i committed some criminal offence, whats going to happen to me - wail??

did you look in your mirror, signalling on thing, looking is another. Have you checked out the road IS a no right turn? They might be trying it on.

dizzywitches · 19/10/2008 23:39

did you report it to the police at the time of the accident? its not up to the insurance companies to decide who is at fault if the police have been informed

pinkyp · 19/10/2008 23:39

if there only claiming 4 damages let ur insurance sort it out. You will be asked for ur account of events etc. Have the police contacted u? sounds like from what u said that the bloke on the bike if after some compo from one of these "no win no fee comapnys", in my opinion he ran into u, his fault - u signaled etc....

Don't panic it was an accident even if you broke the highway code, but you did not set out to break the law so it's no criminal offence. The insurance companies will battle it out. It would help if you have a witness. For £10 some companies will immediately give you Legal Advise, even if your insurance policy did not include it. Just google it.
Not nice, but you'll be fine. Been there, done that...

Yes, you need to go back to the road and check out the signs.
Why do you believe the motorcyclist was at fault?
Did you turn into his path, or did he drive into the back of you?
I hope no-one was hurt.

hi,
yes i looked in the mirror and signalled but then had to wait for a gap in oncoming traffic, so he must've been coming rather fast to get to me in the short time before i actually made the manouvre.
police were there - they stopped off on the way to another accident. was awful, i was breathalised and cautioned as if i was a criminal, all the time my 9mo screaming in the back of the car - thanks god unhurt.
i am literally shaking with rage that someone can crash into my car and then sue me for it!

forgot to mention that my sister was with me, and she sat with the motorcyclist on the road, and he admitted to her that it was her fault. but as she is not an "independent" witness i doubt that makes any difference.

and by the way its very easily done, only last night I did a 3 point turn and went back up a one way street the wrong way and turned right into a junction I shouldn't have been at at all

being breathalised is standard in all RTAs

they will decide who was to blame NOT the insurance companies
am sorry this has left you shaken but pleased you or your lo weren't hurt

So let's get this right, you didn't perform the most basic of checks - looking in the mirror immediately before moving. You turned right into a junction that you shouldn't have turned into, and you could have killed or seriously injured another person. Yet you are "shaking with rage" that this person has the audacity to sue for damages?

Maybe he was going too fast, maybe it's a 50:50, but FFS you must recognise your part in this.
