So yesterday DP and I decided to go away for a relaxing overnight away....then we witnessed a man beat up his wife...then were with police until 4am giving statements....

my SIL's partner keeps doing this to her.

she refuses to prosecute or even report him.

her 11-year-old son stepped in the last time.

he's no so afraid of his father he hangs out on the streets because he doesn't want to go home.

and has become friendly with the local gang.

that's how it starts.

but you can't force her to prosecute or phone the police.

a shite situation.

Ah this happened to use except the kids were there, man was threatening to drown woman (we were near docks), she was petrified. Both vanished before police came but clearly not a first as police recognised description - she was so young and he was nasty in every way- the meanness worse than the threats iykwim.

Pilce charged him after we gave detailed statements, we agreed to appear as witnesses (we were angry as our kids had seen and been scared by it all)- but woman refused to give evidence and took him back (she lived near my Mum).

Hope 2 years on that she is OK; doubt she is though.

Jesus - that's crap of the courts!!! I always assumed that the defendant was collected by the police in serious situations like that!!

Aimsmum - As a magistrate I am TRULY shocked at the sentence, which is completely outside the Sentencing Guidelines we are required to follow and I want to reassure MNers that here in Kent at least, that case would have been listed in a specialist Domestic Violence Court which would not have issued a fine for such an offence - if Cod is around she would probably agree with me for her area. The fact that they are back together is not relevant for the purpose of sentencing, and neither is the fact that the victim did not support the prosecution. I am so sorry that justice was not served today
