Can I have some advice please.
I was involved in a accident in October 2023. A van hit my car from behind at a roundabout. The other drive has admitted liability for damages to the car however there insurance company has accused me of exaggerating my injuries.
A couple of days after the accident I went to A&E my shoulder was xrayer and I was told I had a sprained shoulder. My GP referred me for physio and I recoeved physio through my insurance company. I had 3 weeks off work before returning to work on light duties as advised by my GP. I have submitted all evidence from my employer, medical records and sick notes.
My solicitor has said we now need to start court proceedings and If I lose I would have to pay court fees. Has anyone been through this? I don't think I've exaggerated my Injuries following the accident.

Is your insurer not dealing with this on your behalf? I would have thought they'd be handling this for you.

It doesn't sound like you should have anything to worry about from the court case as you have evidence and are being truthful.

The Insurance company instructed the solicitors. The other drivers solicitor has been ignoring our solicitor and said I have exagerrated my injuries so now we've been advised it needs to go to court proceedings but if I lose I would have to pay legal costs.

Do you motor legal protection on your policy? I would think the costs would be covered by this?
