I recently found out my ex of two children was in a high paid job,so I decided after years of being paid barely nothing I went to the cms, once he received the letter he then threatened if I continued he would quit his job,I decided to carry on with the claim now his conveniently been made redundant with immediate effect! Is that possible? His been in the job for 3 years and instantly made redundant when I continued with cms. He now has to pay me nothing at all
he has cars one worth around £50 grand his In the process of buying a house and is going on a 2 week holiday next week but says he has only £278 to his name so he can’t contribute towards the kids! Is there anything I can do?

look it is what it is everything in his past was on hp so I presumed that was the case now
until recent events! I didn’t come on here to spill my entire life I came here for advice if there was anything I could do for a non paying dad clearly there isn’t so win win for him and total loss for his poor children! I’ll give him a pat on the back for his achievements

The answer is no because maintenance is based on his income not his possessions. Presumably he will just hold back to being self employed and be able to submit accounts worked so he pays a minimal amount. Don't get me wrong the whole thing is set up entirely the wrong way but that is the actual position.

Write to CMS and ask for a full investigation to be carried out.

if he was in the role over 2 years he will have gotten redundancy money

be prepared to keep chasing CMS.

if the house goes through then he will have to be earning to pay the mortgage on it. Presumably the mortgage offer was based on that level of salary so he’ll need to find an equivalent role?

Statutory redundancy is minimal anyway but isn't income.

Mickey79 · 28/07/2024 18:50

If you were on good terms, did you discuss increasing maintenance informally, before going to cms? How much was he paying prior to being made redundant? I doubt there will be much you can do, he has no job. Did you think he was bluffing when he said he’d be made redundant?

very odd not to have claimed beforehand

Not really the issue here!

kittybiscuits · 28/07/2024 19:02

My ex did this, OP. I would prepare to receive nothing. Company (all men) did some shenanigans and put only his job into a separate company then it 'went bust'. He claimed £10k plus redundancy from the government scheme. Never stopped working there. Still works there on his LinkedIn. He hid all his income plus had a massive inheritance. Declared his self employed income as £16k and paid a tiny amount of maintenance on that. CMS let him get away with all of it. Lived like a lottery winner. Man's a cunt. As is yours.

JohnofWessex · 28/07/2024 20:48

Have you done a Companies House search?

He could be a Director of his Employers

Complain to the CMS

There are various questions about

  1. The value of the Company and
  2. Notional Income

Oh and the Inheritance

I complained and I contacted my MP. Nothing happened. Saved himself £25k. DD will never speak to him again.

That’s so bad how they can get away with no up keep for their own flesh and blood takes a real parent to make sure your children never go without! Mine is another form of control over me he will let his children go without just so he can control he still has every control in my life! Now having to work more to compensate a dead beat so he knows where i am what im doing with no life of my own.
you get fined in life for everything you dont pay with bills you dont keep up to date with, balifs are sent to take your possessions but non resident parents have no comeback for not paying for their own children! possessions don’t count even if they won the lottery and never work again they don’t have to pay for their children cus it’s not a taxable income! It’s a joke and yes he is a c@@t

I think it's shameful that he was nothing you less than he should have been when he was earning £105 thousand.

whichfan · 29/07/2024 09:24

you have got on well for the last 9 years? but he sounds like a pig!

You are getting questions so posters can work out the facts to point you in the right direction.

If he's gone self-employed and working for the same company, even if it is a subsidiary of the same larger company whether working directly or indirectly for them, you should report him to HMRC.

As a PP said you should also report him to his mortgage company unless he doesn't have a mortgage.

He's not going to give anything to your kids as if he's 39 he will simply have more children with someone else, or marry someone much younger and not write a will.

Yes he showed me the house for £270 thousand not hard to work out mortgage repayments as it’s tells you at the bottom of the listing if you put a 10% deposit on it the mortgage is then £1500 a month!!

Did you actually just look on Rightmove and think you could go off the fag packet calculation at the bottom on the page?
