I recently found out my ex of two children was in a high paid job,so I decided after years of being paid barely nothing I went to the cms, once he received the letter he then threatened if I continued he would quit his job,I decided to carry on with the claim now his conveniently been made redundant with immediate effect! Is that possible? His been in the job for 3 years and instantly made redundant when I continued with cms. He now has to pay me nothing at all
he has cars one worth around £50 grand his In the process of buying a house and is going on a 2 week holiday next week but says he has only £278 to his name so he can’t contribute towards the kids! Is there anything I can do?

He was employed 9 years ago when we separated I knew his income so he paid the right amount for 4 months then went self employed and was able to spend money on things to keep the cost down on maintenance
his new job now 3 years I was unaware of his income as he works away and only had the children one weekend a month! Only recently I have seen the amount of money being spent on luxury’s when his shit changed and was back every other weekend

Shift sorry phone changed it

wow he managed to keep his wealth on the low down for 3 years. And the children gave no clue?

how do you know his precise earnings and monthly mortgage cost now?

We were on good terms I mean a holiday to Texas to watch the moto gp who had the children me when he turns up in a campervan bragging how much it had cost! When he turns up in a bmw m4 then I started questioning the money he was on so as soon as I went to cms he then turned nasty threatening if I continued he would leave his job

im curious about fact that he’s never been like this stall over the past9 years. No fancy cars? no fancy holiday?

He was like it when we were together though everything he ever owned then was on hp
so I was non the wiser this time!
this time he owns it all

Men are shits my ex deliberately works less than part time hours to keep his child maintenance low he also made a deal with child maintenance people where they agreed that if he has paid it by the end of the month it won't go to enforcement so he will occasionally pay within the first week or two of the month then he will switch it to the end of the month literally the last day so there will be 7/8 weeks in-between payments fortunately it's only £110 max for two children so I don't rely on it but what if I did? He would be deliberately spiting his children (even more than he does already)

He is fully supported by the women in his life and they help him get away with it

i bet he’s kicking himself for suddenly after 9 years telling you the fancy cars and holidays are actually not in HP

i wonder why he suddenly changed?

Only he could answer that question!
but a big factor I looked after the children except one weekend a month so he could achieve his goals for him to then let his children down any way,but guess that’s life you get good dads and bad ones

Because he showed me the house he was buying and how much deposit he was putting down like I said we were on good terms! He couldn’t exactly spend it working away all the time and having the children once a month until his shift changed is when I questioned the stuff he was buying

I know his precise earnings because when you go for maintenance through the csa it’s all written in black and white on the portal

it doesn’t strike you as odd that he’s been very cagey about finances for the past 9 years

and now suddenly is flashing the cash?

look it is what it is everything in his past was on hp so I presumed that was the case now
until recent events! I didn’t come on here to spill my entire life I came here for advice if there was anything I could do for a non paying dad clearly there isn’t so win win for him and total loss for his poor children! I’ll give him a pat on the back for his achievements

shame you assumed 9 years of flashing the cash was all on HP.

How old are the children?

notapizzaeater · 28/07/2024 11:36

If he's used to this lifestyle he will need to work to sustain it, I'd just sit back and wait till he gets a new job then the payments should start again

whichfan · 28/07/2024 11:44

how old is he Op?

Mum2GirlSs · 28/07/2024 12:28

It is possible he has been made redundant.

He could be made redundant and then go self employed with the same company - a lot of people do this ... you'd need to ask for a mandatory reconsideration & then also the FIU & tribunal - where you can take it to tribunal and they go through his finances & lifestyle to see if they match up / hidden accounts etc

I encouraged my friend to do this even though she was ready to give up - 18 months later FIU & tribunal found 8 different hidden accounts & self employed earnings that he had hidden / not declared .... she got it all backdated and the money upped going forwards.

There are some very helpful groups on Facebook for CMS

ok so sounds like he got a tasty redundancy package and he’s splurged

but he will eventually need to return to work and then… CMS will kick in unless he’s gone self employed

StopInhalingRevels · 28/07/2024 18:32

Sandwichgen · 27/07/2024 11:22

Now he’s not working he can have the kids then…. Offer him 50:50 and watch him squirm

Edited

This is so stupid when people trot out this ridiculous "oooh he'll have to do 50/50 then." As if you've got any control over him.

He'll say no. Literally that.

more to the point

why would anyone actively want to be be apart from their children for 50% of the time?!

blondieminx · 28/07/2024 18:39

Write to CMS and ask for a full investigation to be carried out.

if he was in the role over 2 years he will have gotten redundancy money

be prepared to keep chasing CMS.

if the house goes through then he will have to be earning to pay the mortgage on it. Presumably the mortgage offer was based on that level of salary so he’ll need to find an equivalent role?

whichfan · 28/07/2024 18:43

redundancy payout doesnt count for CMS payments in afraid
