I recently found out my ex of two children was in a high paid job,so I decided after years of being paid barely nothing I went to the cms, once he received the letter he then threatened if I continued he would quit his job,I decided to carry on with the claim now his conveniently been made redundant with immediate effect! Is that possible? His been in the job for 3 years and instantly made redundant when I continued with cms. He now has to pay me nothing at all
he has cars one worth around £50 grand his In the process of buying a house and is going on a 2 week holiday next week but says he has only £278 to his name so he can’t contribute towards the kids! Is there anything I can do?

a lot to unpick

does he have any access to the children?

you have never claimed cms before? so you presumed / he told you that he wasn’t earning or in receipt of a bean?

whichfan · 27/07/2024 10:41

and you didn’t see this before you discovered he was in a highly paid job?

maine8282 · 27/07/2024 10:48

No I’ve never used cms! He changed his job which meant I had to have the children majority of the time. It was only recently things didn’t add up with all the holidays the camper van and other vehicles he had recently purchased that I decided to try my luck with cms to find out he had been on £105 a year, but then when he was ordered to pay the amount of via cms he then threatened if I continued he would leave his job all in texts and video when he showed up at my house that’s what he would do

JanglyBeads · 27/07/2024 10:49

Presumably you meant to type £105K a year?

maine8282 · 27/07/2024 10:50

Yes £105k a year

OP posts:
whichfan · 27/07/2024 10:52

very odd not to have claimed beforehand

whichfan · 27/07/2024 10:52

and of course he can be made redundant quite suddenly

never used cms

but has he been paying maintenance on a private arrangement?

maine8282 · 27/07/2024 10:57

Thank you but that’s not really helping with the question asked with all the things he owns and the point he is still going on a 2 week holiday is there anything I can do so he has to pay for the upkeep of his children?
I haven’t needed to go to cms before now he was paying yes only a small amount, but u til recently finding out all the things he had brought etc I then decided to go to cms which in turn his followed through with his threat of leaving that job

OP posts:
whichfan · 27/07/2024 10:58

ah so he has been paying

ok… well if he’s been made redundant and not earning, squat all you can do about that i’m afraid

maine8282 · 27/07/2024 11:00

Even though the house is still going through?

maine8282 · 27/07/2024 11:00

Even though the house is still going through?

yep

if he’s not being paid then cms won’t receive anything from HMRC

LuckysDadsHat · 27/07/2024 11:04

You could grass him up to the mortgage company so they pull his mortgage offer if he has been made redundant 😉

whichfan · 27/07/2024 11:04

if he’s been made redundant he won’t be being paid

and i’m afraid
nothing you can do about that

whichfan · 27/07/2024 11:05

presumably this will be a house for his children

maine8282 · 27/07/2024 11:10

I would never stoop as low as him to do this to the children! But honestly going through this when he thinks it’s ok to make his children suffer now I can see why people would go to the lengths of grassing him up

OP posts:
whichfan · 27/07/2024 11:11

if he’s been made redundant
he’s been made redundant
and not his fault surely

maine8282 · 27/07/2024 11:13

You’re right but I still think he asked to be made redundant! He now has a £1500 a month mortgage to pay so income has got to be coming from somewhere

OP posts:
MissingKitty · 27/07/2024 11:16

How are you getting such precise financial details from him when you clearly aren’t on good terms?

he’s single?

many reasons that he might be able to afford
inheritance
investments

indeed

gone from no idea
to a very full picture

maine8282 · 27/07/2024 11:19

We were on good terms I mean a holiday to Texas to watch the moto gp who had the children me when he turns up in a campervan bragging how much it had cost! When he turns up in a bmw m4 then I started questioning the money he was on so as soon as I went to cms he then turned nasty threatening if I continued he would leave his job

Can you afford to pay a private detective to follow him for a few days. I bet he's still working.

it could only be for cash in hand then if cms are involved
