Hi everyone

I need some advice

i received a payslip by email a week ago saying I’d been underpaid by £200
from my old job and it said I’d be paid on 31/1/2023
i was initially over the moon but I still haven’t been paid and ive just seen on my universal credit that they are deducting £125 from my payment this month due to them seeing the payslip saying I’ve received £200
ive sent 2 emails to my old boss and hr department asking if I’m definitely going to get paid but haven’t heard back and have tried calling
I also told universal credit that I haven’t received the money and have shown them my bank statement but they are saying I need a letter from my old boss confirming I haven’t received the money even though I can’t get through to him

im not sure what my next steps should be?
any advice? I’m now £125 down and I can’t afford to be

I can’t give you a quick solution.

As you have already written to HR send a letter before action (Google it there are templates). Give them 14 calendar days to pay. If you still don’t get the money then you can take them to court by making a small claim.

In the letter before action also state that if they fail to pay they need to issue a corrected payslip and advise HMRC of your correct pay or they are in breach of GDPR and HMRC requirements.

At this stage HMRC can do very little but if you don’t get paid in 14 days definitely tell HMRC your payslip is wrong and you haven’t been paid.
