Got a Court Date!!

My god now I am going to be terrified for the next 6 weeks - October 28th we are in court!!

I think it is supposed to go like we sit and try and work things out and a judge tells us what would be the likely outcome if we were to go to the Final Hearing and then we have a chance to work things out again before actually going to the Final Hearing!!

Oh god I already feel sick!! Lets hope that5 this baby doesn't come early now!!

Good news about the date, Twinkie . Might be cutting it a bit fine with baby, mind !

prufrock · 14/09/2004 15:39

Your terrified - what about him. Can we all come, cos I would so love to see the look on x2b's face when he hears just how much a court will give you, and exactly how far it is from what he is proposing.

prufrock · 14/09/2004 15:40

Oh God that was meant to be "You're" and a ?

Blu · 14/09/2004 15:43

Da-Da-Daaaaah!
Do you mean oct 28th is the Final hearing or the date when the judge tells you waht would be the likely outcome?

(and you'll be FINE!)

Twinkie · 14/09/2004 15:46

He obviously couldn't give a shit though or he would have settled!!

You are more than likely to come - any of you can I would be pleased of the support!!

He is offering me about 30k and I am asking for 75k - the equity on the house is 165k alone!!

Have sent him Calderbank so hopefully he will have to pay my costs if the judge thinks he has been a tosser dragging me to court but apparently that is all down to the judge he might make me pay my costs which would really annoy me considering I think I am being completely reasonable!!

Is when judge would tell us likely outcome I think although there is provision sometimes for them to do it all at once and this may be one of those times comnsidering I will be ready to give birth any minute!!

Don't worry, you are in the right, well prepared and charming...so how can the judge possibly refuse you anything?

Hopefully the court will award ne higher than what I am asking for so yes at least 50% I am just scared that they won't afterall he must be pretty convinced to risk going to court mustn't he??

God at this rate the baby will be here in a week or so - does stress bring on labour do you think??

Twinkie,

Still plenty of time for him to try and settle - very common for him to inundate you with lots of detail 24 hours or so before hearing (common tactic). He may also be going to court thinking that he hasn't anything to lose...

Good luck!

Twinkie · 14/09/2004 16:11

Sorry if I sound an idiot but what do you mean with regard to the inundating me with detail??

He has loads to lose too thats the thing - I am asking for not much and there is far more that I can be awarded - god I hope he comes to his senses and settles and I don't have to go to that awful place again it was bad enough last time and this time I will be fat and hot and tired and huge!!!!

Freckle · 14/09/2004 16:15

EVen if he agrees to settle now, you would still have to go to court, although really the court's function at this point would just be to rubber-stamp the agreement. You would need to be there for the judge to ascertain that you were happy with what he was offering (and there's no guarantee that the judge wouldn't decide it wasn't enough - even if you agreed - and awarded you more!).

Twinkie · 14/09/2004 16:20

That would be the icing on the cake Freckle and so kick him into touch and his arrogance straight out of the window - I jusr fear that he is going to get to walk all over me!!

prufrock · 14/09/2004 16:31

Twinkie - just stop stressing. Can I remind you what happened last time your smug x2b went to court knowing he was right and would get exactly what he wanted? Where is dd now?

Twinkie · 16/09/2004 12:28

Sorry to bring this up again - apparently this is going to be the Financial Dispute Resolution - what does this mean - the judge will tell us what he would order if it ended up in court right and then we are supposed to go away and hash something together so we don't have to go to court proper - is that right??

So if they say to x2b she would get half can I say oh right I want half and it will be in his best interest to give it to me rather than take me to court??

Will the court definately order the same as the judge at the FDR??

OP posts:
Twinkie · 16/09/2004 14:53

Anyone - what will happen at the FDR??
