Shared / Communal Garden

Hi there,
I have recently moved into a flat that has a shared garden area. The thing is, one of my neighbours has claimed a large section at the back for themselves, and installed a padlocked gate to keep everyone else out! I was wondering if anyone had any advice on how to handle this? It does state in my title deeds that the entire area is communal. Many thanks!

First I'd ask the the landlord/letting agency about it. It could be that this person is paying more to have a bit of garden as their own.
