MEDICAL RECORDS what to do if you suspect someone has looked t yours without permission

Hi I strongly suspect someone I know who works in NHS has been looking on mine and my families medical records. Do you know if there Is there anyone I can get in touch with to put a stop to this? Thanks

I would write to PALS at the hospital (or to the Practice Manager if it's your GP records) outlining your suspicions/concerns and asking for the issue to be investigated on your behalf.

Get in touch with PALS - if it's an electronic record, it shouldn't be a problem finding out as the system should have login and password specific to individual users. If it's paper records (as in hospital), unless your relative can access all records in line of work, then there should be a record of any requests for accessing those notes (and normally with a reason such as clinic appointment or hospital admission).

Thanks both of you I will get in touch with pals. It is my exp sister who I suspect. He slipped up last week about my sister having an MRI scan and me having a double prolapse. She can access this info as she is responsible for updating medical records computer programs.

How did you get on?

I am interested in this because I have access to GP and hospital records, and I would not dream of accessing anything without a legitimate reason. I would be appalled to think that someone in a position of trust would do this. I would certainly not access anything to do with a relative's record.

It is very easy to find out who has looked at which records, and when.

I recently dealt with a case which had come via the Information Commissioner's Office, where it was suspected that various patients had had their whereabouts sold on. I mention this because it shows how seriously this kind of breach is taken.

Each NHS organisation has a Caldicott Guardian who is responsible for ensuring confidentiality is preserved. If PALS have not already passed the inquiry on to the CG at the Trust, you should escalate this to them.

What is PALS? I also suspect that someone has accessed my mother's medical records. She has been in a NH for the past 12 months. We did not tell a family member her whereabouts as he is abusive, financially exploited her, etc. He just got out of prison a week ago and showed up at the NH yesterday looking for money from her. I suspect his ex wife, she works in the medical records at a hospital that is affiliated with her doctor, the use the same network. I have looked that far into it. I seriously suspect her but would like it investigated rather than making a bold allegation as I know these accusations are very serious.

I just can not see how else he would have found out. There are literally only four people who know her whereabouts. He called us once he found out and stated that "he has his ways"'

It should be noted that I am her healthcare proxy. I have alerted the NH and told them of my suspicions.

You might want to start your own thread as this one is from 2013. PALS is Patient Advice and Liaison Service, every hospital has one. I would report your concerns to the hospital and ask them to refer the matter to their Caldicott Guardian. There's a download on the page I've linked to which has a list of CGs - you may want to contact him/her directly, or look up the details on the hospital website.

I would ask her doctor about record sharing, it sounds as if you think staff at the hospital use the same IT system as the GP? It's certainly possible that they have access to it, but sharing can be disabled for individual patients.

I suppose the other issue is what to do with your mother now he does know where she is. Has he broken the terms of his licence by contacting her? It would be a shame if he had to go back to prison (not).

Hi There, I have the same problem and have been given specific advice from the healthcare trust. It is not as straight forward as you might think as they advise not to go to the GP in the first instance

Hi wonder if anyone can help as I was told on Sunday that my daughter in law had accessed my medical records??
As she works in a pathology lab she had gotten hold of my test tubes for tests I am currently under going, she then told me she knew the results but could not say anything but to ring my Dr but not mention her name as she shouldn't be looking through my records 😮 I am really worried now don t know what to do, please help

Yes it’s happed to me few times ! My neighbour who a nurse snooped and shared with her co workers I found out through someone I know ! She shared to her our neighbours! But also the hospital was covering for her and I found my data taught to tracing students with out my consent ! I did not agree to it ! But ignored and used it anyway the nurse who told me she knew about my Medical should not have shared to family and friends ! Nothing has been done
