old rules CSA calculation - can anyone help please?

Am a regular but namechanged.

So DH gets a call from CSA asking for his last 3 pay slips and our mortgage statement.(is this routine? seems a little odd, they usually just write).

He has been paying CSA since 2001 for his DS1.

We had our second child together earlier this year, so we now have 3 children living with us (our 2, plus my older child). His DS1 comes to stay with us most weekends for one night (but his mum makes sure not every week so that it's less than 52 nights a year!).

We are a little concerned because DH now earns 7k more than the last calculation. although I left work 2 years ago and earned 8k which under the old rules, they did take my earning into account, saying that I could pay for my own children.

I left work due to my DS1 needing hosp appointments etc and I now get DLA and carers allowance for him. So going back to work isn't an option for me.

So basically although DH is earning 7k more than the last assessment, we have another child together and I haven't been working for the last 2 years (we didn't tell CSA because we were happy paying what we were). But we really can't afford to pay anymore.

Does anyone know whether if we are an old case, we will still be calculated under the 'old case calculations?' Or will we move onto the new rules? If it's the new rules then we're screwed! I can't find a calculator or any info on the old rules, just that they are different if calculated before 2003.

Please can someone/anyone help?

we had this a recently,phone call is normal they then send the forms etc.We were in the old system and tehy calculated it again on the old system ,they said they were just reviewing it as it was a long time since the case had last been looked at.

Going on the changes you have mentioned my guess would be that you probably wouldnt end up paying more.

dont think they would take your benefits into account but i was quite cross as they took all our tax credits into account as income even though a big chunk of it was payments towards our childcare.

You will be assessed under the old rules for as long as the case is open. Someone must have asked them to do a new calculation, because they don't do it off their own backs. At the moment, we are having a recalculation done, but the other way around. My eldest is 19 nad DS2 is almost 17, so my lovely ex hisband didn't want to pay any more money. Obviously, DS1 is no longer a child, but DS2 still qualifies1

I got a letter asking for new info about the boys, so I phoned them up and was told that the new assessment would be under the old rules, as that was how the case was first assessed and that, unless I asked them to investigate his current earnings, the assessment would be made based on the income that they had on file for him. This income is 11 years out of date and bears little resemblance to his current salary. The reason that the figures are so old is that he has never volunteered any new nfo (surprise, surprise) and I have never asked them to look at things again, not wanting any more from him than necessary.

I can't remember how the old rules work, as it is so long since we had an assessment done, but I shouldn't think that you would have to pay any more as you have more children and you aren't working any more.

I won't worry so much if it's under the old rules.
We like paying the amount we do because it allows us to treat him to things as well but if it was what the calculator says it should be we would be in a mess!

I used to work in the CSA under CS1 rules - I was a face to face officer, so if you have any queries, don't hesitate to ask - I can even do a rough calculation for you if you like.

Hi. Just found your post from October. My husband pays CSA under the old rules and we are just in the middle of a reassesment.
