I need some help. I have no assets and the only income I have is my kids child benefit. I am not entitled to any benefits due to my partners salary. I have to pay off two debts - one a student loan which they will not let me defer and another very large debt. Can they take my child benefit off me? Surely it is for my children and they cannot touch it. If they can would it be better to transfer the child benefit into their fathers name or would they still be able to touch this too? If I earned the same amount of money as I get in CB I'd be happy to come to an arrangement but I think it is wrong that they could take money that is meant for my kids.

IIRC benefits are not allowed to be taken to repay debts.

How are you planning on repaying though if you have no income, is your DH paying?

No one can take the money from you (and definitely not your dh). Why don't you just pay them £1 a month or whatever you can afford until your circumstances improve. If they proceeded to a county court judgement against you they would only get a £1 a month as you have no income.

Thanks! I wasn't planning to use OH to pay but I've read that if I go bankrupt it will cost me around £400 but if I'm made to go bankrupt it will cost over £750.
