I have sent letter recorded delivery but person has not collected it!

The letter was a demand for payment by today. The letter also stated that if I did not receive payment today I would issue summons in small claims court. Can I go ahead with summons? Must i send another demand letter?

Send another in a large padded envelope with a printed label and froma different post code. Include an empty CD case or something similar.

How do you know it hasn't been received - are you using the Royal Mail tracker thing? If so, don't believe it - it's pants! I sent some eBay stuff and buyers have already left feedback, but RM is still saying it has no record of delivery .

Could they have gone into liquidation? DH had this with a debtor recently - mail could not be delivered as there was no one at the office!

Thanks for all the feedback! The letter was sent to an individual for money owed to me. I saw her at the shops two days after delivery was attempted according to Royal Mail Tracker thing! She said that she had not heard from me so I said that the letter had been send recorded delivery "Oh, that is what the slip is for!", she replied.

So I assumed she would have gone to collect it. Except of course that she knows it is a demand for money so I wonder if she has perhaps not collected it. I will do another hand delivery as I did with the first notice of cancellation of contract I sent to her.

The thing is that my demand letter stated that I would proceed with a small claims court summons if payment was not received by 26 November. Then the lurgy struck and I have been in bed for a few days. Now that I am up and about again, I want the matter sorted asap.

I will hand deliver tomorrow then because I know she does not work on Saturdays.
