If husband buys a flat whilst we are living apart would I have any claim on in in a divorce?

My husband and I have been living apart for two months (his choice) and he is looking to buy a flat. We are not divorced or legally seperated and I was wondering if I would have any claim on the property in case of a divorce.

Can anyone help?

The courts look at needs and resources - what are the needs of each party and what resources are there to meet those needs? Do you have children? Do you work? Does he?

All assets will be taken into account in dealing with the finances. Whether you have a claim on his flat will depend on whether there are sufficient other assets to meet your needs.

Thanks Freckle. I don't work and he does. We have two children age 1 and 3.

To be honest I hope it would strengthen my claim on the marital home if he was happily housed.
