H is a taxi driver, and works for a company not himself, the company do school runs, and 6 weeks ago it appears he was taking a young boy to school, this boy later complained that H had hit him on the leg and bruised him, H first claimed it was just banter that got out of hand, however he has now admitted, he hit him out of temper because the lad was messing around with the car sterio, and he now has to await a court case.

Will this have any affect on his access to dc, H is not normally violent, so not sure where this has come from, however if I am honest he was often bordering on verbal aggression, he deserves everything that is coming to him, the poor lad was distraught, so not defending H in any way, just after info on what will happen next, will I be interviewed for example?

not good news surely he will also lose his job and rightly so

isnt it up to you to agree access to dc with him

mybrainaches · 11/06/2008 17:05

Thats what I am not sure about to be honest, we have only been seperated 3 months, no idea how this works, should I get legal advice? should I worry he has the kids even tho no history of violence towards them? he certainly is not the man he was 3 months ago, what with the court case and his treatment towards me that I never thought he was capable of.

i think usually you agree childcare between you unless there are issues

so i would say it is your judgement really

we never had any legal involvement ocncerning childcare or indeed fianances or anything else except divorce

mybrainaches · 11/06/2008 17:10

Yes, same here, currently going through divorce and statement of arrangments for children that states we are both happy with dc living with me and regular access by h, but this has rocked the boat a little.

i think you have toi have a discussion with him if that iisnt feasible then a discussion with a mediator to assist

mybrainaches · 11/06/2008 17:11

The worst part is, the lad he punched has ASD, as does our ds, so it has affected him quite badly.

and he could enrolhimself in anger managment and talk to gp about his stress/mental health

zippitippitoes · 11/06/2008 17:13

he will no longer be suitable as a taxi driver as he has to have an ehnaced crb and i think this would be totally unacceptable

edam · 11/06/2008 17:13

I think you should get a solicitor and discuss this with them. It is an important, relevant and new piece of information that should be taken into account when discussing access.

zippitippitoes · 11/06/2008 17:14

assuming he is conviceted

mybrainaches · 11/06/2008 17:14

Yes he needs to have a clear criminal record, I have no pity for him.

mybrainaches · 11/06/2008 17:16

As he has admitted it, surely a conviction is inevitable.

OP posts:
zippitippitoes · 11/06/2008 17:17

well yes it will be

i still think that unless you opt to bring the matter to a court or mediation to decide it is up to you whether it is an issue wrt your dc

mybrainaches · 11/06/2008 17:20

Thanks for the advice, I will see what happens before I decide what to do I think.

Am not sure actualy if the charge is, assault againsed a minor, or child abuse, I wonder if they amount to the same thing, or if the punishment differs depending on the charge.

OP posts:
mybrainaches · 11/06/2008 19:30

Anyone know roughly what his punishment will be?

OP posts:
zippitippitoes · 11/06/2008 19:54

i dont know

mybrainaches · 12/06/2008 17:58

My mum thinks I might be interviewed as he assaulted a child with special needs, the same special needs our ds has.
