If Social Security Scotland wrongly stop my ADP and I lose my Motability car, can I get compensation if it affects my job?

It totally depends on the specifics on why it has been stopped, your actions, the complaints procedure etc.

I am in a situation where I can barely walk. I need a car to get around and am considering a local job outside the home.
from the time it took to submit my case, receive a response, submit an appeal, the mandatory reconsideration (also rejected), it took over two years for my case to go to tribunal and I was then awarded the higher rate. Social security Scotland didn’t want to award me but a tribunal did.
I am getting a car soon. But before I take any job that relies on me having a car, I want to make sure that is social security Scotland unfairly stop my benefits and I subsequently lose my job that I can be compensated for that.

Why do you think you will lose the car? If it seems highly likely, I would not start the job until I knew the outcome. A new employer won't compensate an employee who cannot fulfil their duties.

No you won’t be compensated but I would be more concerned about losing the car not the compensation you would get, because if you need the car and lose it the effects of that are far worse then any compensation surely? What makes you think they would unfairly remove your ADP?

it took years to get approved for the payment in the first place. If my circumstances improve or change, I will need to submit a review, and they could easily take my payment away again. They aren’t exactly fair with their decisions, aren’t about 80% of decisions over turned at tribunal

what if social security Scotland (unfairly) suspend my adult disability payments upon a review or change of circumstances? And then I lose my job.
i would have to go through the whole tribunal thing again, it can take years.
what if I am then awarded my payment at tribunal with a backdate for the entire time that my payments were suspended?
can I get compensation from social security Scotland for inevitably losing my job as a result of losing the payment and therefore the car

The award will be for a set period. If your circumstances don’t change inn that time your payments won’t be stopped.

You will need to appeal then tribunal you wont get the mobility component if they don't think you are entitled and they definitely wont compensate you.

App is asking if she loses it at review and has to go to tribunal again though.

Very strange. Who starts a job thinking something is going to be removed. You deal with said "issue" before commencing employment. It is down to you and certainly not your future employer.

To be fair to OP her review could be in a few years. SSS could decide not to award her ADP and it can take as long as 2 years to go through the appeal process during which she would lose the car.

edited to add OP wasn’t asking if the future employer would be responsible

She is going to leasing this one using her ADP payments. It’s not free, she is still paying for it.

There was something on the news over the weekend saying that the Government was thinking of taking the tax relief off motability cars, but they have denied it. This is perhaps what the Op was talking about?

No OP is worried about no longer qualifying for high rate mobility in the future and how it would affect her

Where did I say the car on motability was free?! I know its not!
Its a lot of money to pay out but if they stopped her disability money she would be without the car as it would need to be returned.
But if she saved that money & brought her own it wouldnt need to be returned and no need for op to worry if her money was stopped she wouldnt be able to get to work.
