Child maintenance review shocker

Got child maintenance review today. DC dad declared he earned £13,248 last financial year. He claims he works 6 days a week and is always late picking dc up due to work and works every weekend even the Saturdays he has dc. He owes £1254 in arrears via the cms and £2500 from before I applied to the cms (obviously I have written that off) so now I get the princely sum of £29.30 a week but not before cms have taken their 4%.
is this a joke? How do men like this have no shame? I know there is nothing to be done I am just venting. I have never included his money in my budget thank god but that doesn’t mean I don’t need it! I work full time and I work hard but why do men think this is ok? Why do the girlfriends think this is ok? Why do the father’s parents think this is ok? I have 3 boys and no way would I be congratulating them on avoiding maintenance.
Oh, and he’s a plasterer 🤣

the system in this country is outrageous.
In America they take passports , driving licenses.
I never received a penny , I would tell them he worked, he’d leave.

It’s outrageous yet nothing changes. I am so sorry - I started posts on chat, aibu and money matters 🙈 I needed a response and to vent otherwise I would end up messaging him how disgusting he is and I refuse to do that. Makes me sick why people think it is ok.

Exactly! If he paid what he should I wouldn’t need bloody UC (which I hate receiving and I work full time) and he slags me off for claiming that!

If what he is declared is correct then he is not earning the minumum wage... I would suggest you contact his company and say you will be reporting them for failure to pay it, as the minimum wage for age 21+ is £12.21 for a 35 hr week (the British average) is £22,222.22*... and then talk to HMRC.

I think for CMS the lowest you should be able to say you earn is full time minimum wage - similar to UC rules.

I worked it out too given all the hours he says he is working. If you are self employed do the minimum wage rules still apply?

I hate men too. Apart from a couple of genuinely decent ones. Hell will freeze over before my sons ever get away with this kind of shit.

I’d still try and shop him in. If he texts you that he’s working all the time submit the texts as evidence. Minimum wage doesn’t apply to self employed people but it would be very strange of him to be paying himself that little. He’s probably paying all his bills etc through the work accounts.

A simple solution is for courts to not accept anything less than full time minimum wage earnings without evidence of medical inability to work. I suppose you could be able to show a one time catastrophic business loss so bad you couldn’t pay yourself minimum wage that year, but that means the person should get a job, not keep at the same failed business.

You don't need proof. If you report him to HMRC they MAY investigate.

Unfortunately, if he’s self employed then on paper he could well be earning that low figure. He may be putting a massive amount into a pension to skew the figures or does he have a partner he ‘employs’ which would bring down his profits?

Thank you - I was a twat and scatter gunned the same thread over money matters, chat and aibu because I was so angry 🙈 the aibu thread has more traction - if you want to reply on there? I have reported via email to HMRC and have emailed mp, gingerbread, MNHQ, and looking to see what else. None of this is ok and I am disgusted by the stories people are sharing
